Are Hotel-motel Taxes Unconstitutional?

Taxation is a profile of regulation. The interstate clause of the U.S. Consttitution (Article l, section 8) authorizes Congress to steer interstate commerce. Since hotels and motels do business with interstate travelers they are involvel in interstate marketing. Hotel-motel taxes are levied by towns and cities rather than by Congress; thus the lattter are regulating interstate business. Is this unconstitutional?

Answer: The hotel's task is done in one place. The fact that the guests are travelling is irrelevant.

If this were true, everyone would live not far off a state line and get tax refunded by shopping in the neighboring state, thus making it interstate traffic.
